  • Plaintiff was the representative of X who had told Defendants that if they paid off the mortgage on his house then they could have the house. They began to pay off the mortgage.

  • Plaintiff tried to revoke the offer, once X had died.

  • The CA held that a unilateral contract could not be revoked once the offerees had commenced performance, provided their performance was not left “incomplete and underperformed” - Per Lord Denning
