Defendant had a contract with Plaintiff governing the royalties and use of material of Jimi Hendrix.

It was impossible to quantify the claimant’s financial loss, so the court ordered him to pay a “reasonable sum” that Plaintiff could have charged for the use of the material.

Despite this also being a case, like Blake, where the profit was made from breach of contract, the court did not order all the profits to be awarded in damages, since the subject matter was far less serious in its nature than the national security concerns in Blake.
