  • The ECJ said that a General Agreement on Tarriffs and Trade (GATT) provision could be used to show that an EC measure was incompatible with the agreement (but NB only where the EC intended to impose the relevant GATT obligation OR where it referred to the GATT obligation) even if no rights cold be derived from it (broader concept of direct effect).
