A draft agreement whose effect would be to sever the property was not formalised before one party died.
The court held that here was no mutual agreement between the parties that the joint tenancies of the properties should be severed for, although they had reached an agreement in principle, each party had reserved his or her rights and it was open to either of them to argue for some other financial arrangement at the divorce hearing.
