Jameel v Wall Street Journal Europe [2006] UKHL 44

  • Plaintiffs company were defamed in a wider article by Defendant’s newspaper about companies under investigation for links to terrorism.

  • HL said that the newspaper would be acquitted of defamation because:

    1. The article was on a matter of public importance and

    2. "Responsible journalism” requirements were fulfilled (e.g. verification of sources, etc.).

  • These are the 2 essential ingredients that allowed a qualified privilege (i.e. where only malice can overturn the privilege) and can, as here, protect an article from defamation claims.
