Plaintiffs company were defamed in a wider article by Defendant’s newspaper about companies under investigation for links to terrorism.
HL said that the newspaper would be acquitted of defamation because:
The article was on a matter of public importance and
"Responsible journalism” requirements were fulfilled (e.g. verification of sources, etc.).
These are the 2 essential ingredients that allowed a qualified privilege (i.e. where only malice can overturn the privilege) and can, as here, protect an article from defamation claims.
