  • Plaintiff was a journalist and broadcast an interview of him questioning 3 racists who made racist remarks on air.

    • The interviewees were convicted of breaking race laws and Plaintiff was convicted with aiding and abetting.

  • European Court of Human Rights said that his conviction was a violation of his freedom of expression under Article 10.

    • The court said that the purpose of the programme was not in any way racist and that it was hugely important that phenomena like racism could be discussed publicly.

    • Without the ability to show such programmes, the press couldn’t act as a watchdog
