Malone v Metropolitan Police Commissioner [1979] 2 All ER 620

  • Victim’s phone was tapped by Metropolitan Police Commissioner (MPC) and he claimed a right of privacy under the ECHR (NB before the HRA).

  • However the ECHR had no force in UK courts (since it hadn’t been incorporated into UK law) and common law recognised no right to privacy, meaning that the MPC had done nothing contrary to English law in using the phone taps.
