Can international agreements, entered into by the EC, have direct effect?
It was decided that because of uncertainties surrounding the General Agreements on Trade and Tariffs (e.g. possibility of derogation) and later World Trade Organisation (WTO) that individuals could not derive specific rights from the treaty.
However in other cases (Racke, concerning EC-Yugoslavia agreement) the ECJ has been willing to grant direct effect, therefore it merely depends on certainty of the treaty
