Plaintiff and Defendant were drunk and drove home on Plaintiff’s motor bike. Pitts, encouraged by Hunt, drove dangerously, causing an accident in which Defendant died and Plaintiff was injured.
Plaintiff sued Defendant’s estate for damages.
CA held that due to the 1988 Act, s.149 (3) (see above) the defence of violenti non fit iniuria couldn’t apply.
