  • Defendant damaged RAF property to try and prevent the damage to others’ property in the Iraq war which Defendant believed to be illegal. 

  • Defendant relied on defence of private defence AND necessity but was convicted. 

  • CA said that s.3 Criminal Law Act 1967 (private defence) AND necessity only related to the prevention of a domestic “crime”, and “international aggression” was not justiciable in national courts.

  • Thus appeal dismissed.
