R v Olugboja [1982] QB 320

  • This was a case where a man told a woman that he would have sex with her (this was after his friend, as he knew, had raped Defendant the same evening, and had now dragged Victim’s friend into the bedroom). He ordered her to remove her trousers, and penetrated her though she did not struggle.

  • She sued him for rape and he was convicted, the judge leaving the issue of consent as a question of fact.

  • The CA upheld his conviction, since intimidating someone into having sex does not mean that they consent.
