R v Radio Authority ex p Bull [1995] 4 All ER 481

  • Plaintiff, a political human rights group, wanted to advertise on the radio.

  • An act said that political broadcasts were not allowed (except in prescribed circumstances) and, since the content of the advert was political, the Radio Authority (RA) refused them permission.

  • CA said that this was part of a licensing system and therefore Article 10 was irrelevant (Article 10 specifically allows for licensing restrictions).

    • Also discretion had to be given to RA. No grounds for judicial review of RA’s decision.
