Reyners v Belgium [1974] Case 2/74

  • The ECJ said that because the Belgian government was taking too long to introduce to national law a fundamental principle of the EEC treaty (non discrimination of persons based on nationality), that it would give direct effect to the treaty provision.

  • This was justified on the grounds that another member state, with no relevant disparities in law with Belgium, had managed to implement the law.
