The ECJ said that because the Belgian government was taking too long to introduce to national law a fundamental principle of the EEC treaty (non discrimination of persons based on nationality), that it would give direct effect to the treaty provision.
This was justified on the grounds that another member state, with no relevant disparities in law with Belgium, had managed to implement the law.
