Plaintiff 1 and Plaintiff 2 were taken into care and allegedly placed with abusive families. Applications to strike out the cases were granted.
CA reversed the decision in case 1 since there is no general immunity for local councils in this category of cases + there was a reasonable chance of success.
In case 2 the same applied regarding no-immunity, BUT looking at the evidence, there was NO chance of success and therefore no point in letting the case go to trial.
