  • However she does not exercise any public functions

• Thus mere fact that Claimant is well-known does not necessarily mean public has legitimate interest in seeing photos of Claimant going about her daily business.

Article 10

• Relevant factor is that photos were often taken in climate of continual harassment.

• Additionally her private activities are not relevant to any debate of public interest

  • Rather are solely to satisfy curiosity of readers

On facts, Claimant’s Article 8 rights had been breached.
