Wieland v Cyril Lord Carpets [1969] 3 All ER 1006

Country:
United Kingdom
  • Defendant caused Plaintiff to have a neck problem and made her feel shaken so that, in addition to her neck-collar, her vision and judgment of space was faulty. She fell down the stairs and sustained further injuries.

  • QBD held that she could claim damages for the second injury as well as the first from Defendant, since the second fall was Defendant’s fault too.

Eveleigh J

  • If foreseeability is required, it is enough if it is foreseeable that one injury may affect a person's ability to cope with the vicissitudes of life and thereby be the cause of another injury.
